I had booked a trip with Make My Trip last year, which I had to subsequently cancel as my VISA got rejected twice. The cancellation was well within the cancellation period.
I had paid INR 77,399 in two installments. They had mentioned cancellation charges of INR 50,524 when I booked the tour in my booking document.
The 77,399 consists following - 72,308 booking charges, 3591 TCS and 1500 visa assistance charges.
So deducting all these amounts I am left with a refund claim of 21784 (77399-50524 cancellation - 3591 TCS - 1500 visa assistance).
However they are offering to refund only 14k.
When I asked for a line item breakup of how they reached the 14k amount - they said they cannot provide one and closed my ticket with a note “customer refused refund”.
I reopened an escalated ticket - which proceeded in a similar fashion which they closed under the context “if the customer does not reply within 2 days, we close the ticket”
I have raised a 3rd ticket, which is sitting in their bins for a month now and refund is pending for 8 months.
Their IVR is pathetic and directs me to using help option on web/app, but there is no such thing listed for that specific trip on the web/app.
I need help/suggestions how should I pursue a legal battle and drag them to court over the delayed refund and closing my ticket unlawfully, claiming “Customer refused refund”
